This ambrotype was taken in 1859 by Amon Gilbert DaLee, per the Kansas Historical Society's website (see above). The photographer died in 1879 per an entry about Mr. DaLee in the book "Pioneer Photographers of the Far West: A Biographical Dictionary, 1840-1865" on p. 192 here: https://books.google.co.jp/books?id=Nne4L9h27RsC&pg=PA192 Thus, this photograph was taken in the U.S. by a photographer who has been dead for more than 100 years, so the image is in the public domain.
